Lasting Power of Attorney Explained
What is a Lasting Power of Attorney (LPA)?
A Lasting Power of Attorney (LPA) is a powerful legal document that allows you (the ‘donor’) to appoint one or more trusted individuals (known as ‘attorneys’) to help you make important decisions—or make decisions on your behalf—if you’re unable to do so yourself.
By setting up an LPA, you can ensure that you stay in control of what happens to you, even if an illness or accident means you can no longer make decisions independently. This legal protection offers peace of mind, knowing that your preferences will always be respected, and your loved ones won’t have to navigate complex legal processes during difficult times.
Health & Welfare LPA
A Health and Welfare LPA gives your attorney the authority to make decisions about your health and personal care, including:
- Your daily routine (e.g., washing, dressing, and eating)
- Medical treatments
- Decisions about moving into a care home
- Life-sustaining treatment
This type of LPA can only be used if you’re no longer able to make decisions for yourself.
Property & Financial Affairs LPA
A Property and Financial Affairs LPA allows your attorney to manage your finances and property, including:
- Managing your bank or building society accounts
- Paying bills and expenses
- Collecting benefits or pensions on your behalf
- Selling your home, if necessary
Unlike the Health & Welfare LPA, this can be used as soon as it’s registered, with your permission.

How to Sign and Register Your Lasting Power of Attorney
Signing your Lasting Power of Attorney is straightforward. Will Writing Network provides clear instructions and labels on where to sign, ensuring you’re 100% confident that the documents are completed correctly. Once signed, you’re ready for the final step—registration.
To make your LPA legally binding, it needs to be registered with the Office of the Public Guardian (OPG). The OPG charges a registration fee, which ranges from £0 to £82 per document, depending on your circumstances.
While the registration fee isn’t included in our service costs, we’ll guide you through how to pay it directly to the OPG. You can choose to pay by card or cheque. If you opt for card payment, the OPG will contact you directly for the payment when needed.
Keep in mind that there’s no set deadline for registering your LPA once it’s signed, but it won’t become legally effective until it’s officially registered.
